HEALTH WAIVER

By signing up for and/or attending Cyclo Studio classes, activities and other programs, and using the premises, facilities, and equipment of Cyclo Studio (collectively, “Classes and Facilities”), you hereby agree that there are certain inherent risks and dangers in indoor cycling and exercise and in using indoor cycling and exercise equipment in association with the Classes and Facilities.

 

In consideration of being allowed to participate in and access the Classes and Facilities, in addition to the payment of any fee or charge, you hereby agree to assume full responsibility for any and all injuries, losses and damage which may be sustained or aggravated by you in relation to attending the Classes and Facilities, waive, release, hold harmless and forever discharge Cyclo Studio and its affiliates and their officers, managers, agents, members, employees, representatives, and their successors and assigns and all others (the “Released Parties”) from any and all responsibility, claims, rights, causes of action and/or liability from injuries, losses or damages to your person or property which you may or may have, now or in the future, known or unknown, that may result or arise from or be related to your participation in and use of the Classes and Facilities (“Release”), acknowledge that you will insure or self-insure against all injuries, losses or damages and will look solely to such insurance or self-insurance for any and all recoveries which may result from such injuries, losses or damages and represent that you have no medical or physical condition which would prevent you from attending and/or using any Classes and Facilities and/or put you in any physical or medical danger, and have not been instructed by a physician or medical professional not to do so.

 

Cyclo Studio hereby advises you that any individuals with chronic disabilities or conditions are at risk in using Classes and Facilities, and are advised against doing so. Should there be any question of the advisability of your participation in the Classes or Facilities, you may be denied access to Cyclo Studio and its Classes and Facilities until you furnish Cyclo Studio with an opinion letter from your doctor or medical professional, at your sole cost and expense, specifically authorizing you to participate in the Classes and Facilities offered by Cyclo Studio. If you decline to obtain such letter, you will not be permitted to use the Classes and Facilities. Cyclo Studio reserves the right to refuse service at its discretion.

Personal Property: You also acknowledge that leaving any personal property on the premises or in the care or custody of Cyclo Studios involves risks of theft, damage, or other loss of use or reduction in value of such personal property and that you shall insure or self-insure against any and all such losses or damages, such insurance or self-insurance shall be your sole and exclusive recourse for any and all damages or losses with regard to all such risks and you shall Release and hold harmless the Released Parties with regard to such risks, damages and losses.

I have read this Waiver and Release and I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Waiver and Release freely and voluntarily and intend, by my signature, this to be a complete and unconditional release of all liability to the greatest extent allowed by the law. The term of this Waiver and Release in indefinite, unless withdrawn by me in writing.
